Supreme Courtn Thursday, the Supreme Court strongly objected to the use of masks and carelessness to the physical distance rules amid Corona’s growing infection. The apex court held that not wearing masks and not following the physical distance law is a violation of the fundamental rights of others. Many people are violating the fundamental rights of others. The court said that the rules of masks and physical distance must be strictly followed, but people are fearlessly violating Corona guidelines throughout the country.

Ban on the order of Gujarat High Court 

However, the Supreme Court stayed that part of the order of the Gujarat High Court ordering those not wearing masks to be sent to the Corona Center for community service. The Supreme Court has stayed the order of the High Court in view of the danger of health, but at the same time ordered the Additional Chief Secretary (Home) of Gujarat to strictly follow the guidelines for wearing masks and physical distance. The notice was also issued on a petition by the Gujarat government challenging the High Court order.

The High Court gave this order 

Even though the Supreme Court did not mention the agitating farmers on Thursday, lakhs of farmers standing on the borders of Delhi are breaking the Corona guidelines. Justice Ashok Bhushan, R.K. The Bench of Subhash Reddy and MR Shah gave these orders during the hearing on proper cognizance of Corona and automatic cognizance in the case of death due to infection. The Gujarat government demanded a stay on the portion of the High Court’s order last Wednesday in which the High Court ordered the dispatch of maskers to be sent to the Corona Center for community service.

Center gave this argument 

Solicitor General Tushar Mehta, appearing on behalf of the Center and the Government of Gujarat, said that the Central and Gujarat Government have issued guidelines for the application of masks and physical distances which are required to be followed. Those who do not apply masks in public places are fined Rs 1,000. The rules are being followed, but the High Court’s order of last Wednesday is very harsh and excessive punishment. By following this, a person can be at risk of disease.

The court said, the guidelines are fine but not being followed 

On these arguments, the court said that there are guidelines, but they are not being followed. It is very easy to follow them. The intention of the High Court would have been right. The Supreme Court said that hundreds of people gather at weddings and rallies. Why does the police not take any action against the violators. Justice Shah said that many people are violating the fundamental rights of others. On these comments of the bench, Mehta said that there is only mask and physical distance between us and Corona, but people are moving without masks.

Follow physical distance 

Mehta said that people tend to break the rules. Instead of wearing a helmet, it hangs on the two-wheeler instead of wearing it. People wear it only on the appearance of the policeman. The bench said that this case of violation of guidelines is not only in Gujarat but it is a national problem. Without creating a system of compliance, just increasing the penalty will not do anything. Referring to the gathering of vegetable mandis, Justice Shah said that there are many vegetable mandis, people should follow the physical distance of six feet there, but no one is following it across the country. These are the places where rapid infection spreads.

Lack of oxygen and beds in Himachal 

Delhi was told that the number of corona patients has already decreased. Everything is being taken care of. On complaints of non-compliance of guidelines in other parts of the country and in various states, the court asked the Solicitor General and the lawyers of the states to give suggestions by December 7 to ensure compliance so that appropriate orders can be given in this regard. Advocate Gaurav Aggarwal said that there is a shortage of oxygen and beds in Himachal Pradesh. On this, the court has sought a status report from the Government of Himachal Pradesh. The case will be heard again on December 9.
